The Duel Case. - On
Saturday morning at 11 o’clock, Messrs. E. C. Elmore and H. R. Pollard appeared
before Justices Riddick and Lee, of Henrico, at the Henrico County Court-House,
to answer the charges of being concerned in a recent duel, in which it was
alleged Mr. John M. Daniel, of the Examiner, was wounded. The witnesses called
were the same as examined before the Mayor, viz: Messrs. J. Marshall Hanna,
George W. Butler and Dr. A. E. Peticolas, and the evidence was substantially the
same, except that Dr. Peticolas put himself upon his right which was
acknowledged by the court, to decline to testify, upon the ground that his
testimony might criminate himself. Mr. Hanna knew nothing of the case of his own
knowledge, Mr. Butler only knew from a conversation with Mr. Elmore that there
had been a meeting between the latter and Mr. Daniel, in which Mr. Daniel was
struck.
Mr. Hanna knew nothing but
what he had heard and which was not evidence.
The case was adjourned, and
the accused admitted to bail till next Saturday, that the Commonwealth might
secure the presence of Mr. Paulus Powell, who, it is intimated, knows somewhat
about this matter.
